Your rights when a hotel overbooks

When a hotel cannot honor a confirmed reservation, they are responsible for a set of minimum obligations. These are enforceable regardless of what the front desk tells you at check-in.

Comparable or better accommodation at no extra cost

The hotel must arrange alternative accommodation of equal or greater quality at no additional charge to you. A "budget alternative" when you booked a premium property is not acceptable.

Transportation to the alternative property

If the alternative property is not at the same location, the hotel is responsible for your transportation costs.

Reimbursement for the cost difference

If the alternative property costs more per night than your original booking, the hotel must cover the difference. If it costs less, you may also be entitled to a refund of the difference.

Compensation for material disruption

When overbooking causes you to miss a planned event, incur additional expenses, or suffer material disruption to your trip, these losses may be recoverable beyond the basic walking obligations.
